Automated systems operate inside a legal framework that already existed long before AI became a boardroom concern. Data protection law, discrimination law, consumer protection, financial regulation, product liability — these frameworks were built around the principle that decisions affecting people must be accountable, explainable and subject to scrutiny. When AI systems make those decisions, the same principles apply.

Law and Regulation explains the legal concepts most directly relevant to organisations that deploy automated decision systems — individual rights, regulatory oversight, compliance duties, liability, enforcement powers and risk classification. These are not future risks waiting to materialise. They are current obligations that apply from the moment a system makes its first decision. Understanding them is not a legal function. It is a governance requirement.

Legal Obligations and Regulatory Requirements

LR-01 - Automated Decision Rights

Automated decision rights are the legal entitlements individuals hold when systems make decisions about them — rights to explanation, to contest a decision, to human review and to non-discrimination. These rights exist in data protection law, consumer law, financial regulation and equality law. They apply now, not when future AI legislation arrives.

LR-02 - Regulatory Oversight

Multiple regulatory bodies have authority to examine, investigate and act on automated decision systems. Understanding which regulators have jurisdiction — and what powers they hold — is a prerequisite for governance. Regulatory oversight is not a future risk. It is a current condition that organisations operating automated systems already face.

LR-03 - Compliance Duties

Compliance with legal requirements is the minimum the law demands. It is not a standard of good governance. The distinction matters because regulators assess conduct against both, and because the gap between legal compliance and genuine accountability is where the most significant governance failures are found.

LR-04 - Liability

When automated systems cause harm — financial loss, discrimination, privacy breach, physical injury — the legal and financial consequences attach to the organisations that deployed and controlled those systems. Liability does not transfer to the system's developer simply because the deployer did not build it. Governance determines who bears exposure.

LR-05 - Record-Keeping Duties

Record-keeping duties are the specific legal obligations — under data protection law, financial regulation, employment law and others — to maintain defined records for defined periods. They differ from governance record-keeping in that they are mandatory minimums, not governance aspirations. Failing to meet them is itself a legal breach.

LR-06 - Regulatory Investigation

Regulatory investigation means a formal examination by an authority with statutory powers to demand documents, interview staff and compel cooperation. Organisations facing investigation must be able to produce governance records quickly and completely. Governance arrangements that look adequate at deployment but cannot be demonstrated under investigation do not satisfy the standard.

LR-07 - Enforcement Powers

Enforcement powers are the actions available to regulators when they find that an organisation has failed to meet its legal obligations — including requiring system changes, imposing financial penalties, suspending operations and pursuing personal liability against individuals. The range and severity of powers varies by regulator and jurisdiction.

LR-08 - Legal Challenges

Legal challenges are the formal mechanisms through which individuals and organisations can contest automated decisions in court. They include judicial review of public body decisions, discrimination claims, data protection rights enforcement and contractual challenges. An organisation that cannot reconstruct and justify a challenged decision is in a structurally weak legal position.

LR-09 - Consumer Protection

Consumer protection law applies when automated systems influence what people buy, what they pay, or what choices they believe they are making. Misleading AI-driven recommendations, algorithmic pricing that disadvantages specific groups, and opaque automated offers all engage consumer protection obligations that exist independently of AI-specific regulation.

LR-10 - Data Protection Duties

Data protection duties apply whenever an automated system processes personal information. They include obligations to minimise data collection, maintain accuracy, limit retention, respond to individual rights requests, and conduct impact assessments for high-risk processing. These are current legal obligations in every major jurisdiction.

LR-11 - Regulatory Reporting

Regulatory reporting is the obligation to proactively inform regulators about incidents, significant changes to systems, and material risks. It differs from responding to investigation. Organisations that self-report promptly are treated differently from those whose failures are discovered by regulators. Governance must include defined reporting triggers and processes.

LR-12 - System Suspension

System suspension is the power of a regulator or court to order an automated system to stop operating. It can be temporary pending investigation or permanent following a finding of breach. Organisations that cannot stop their systems quickly, safely and completely face additional risk when suspension orders are issued.

LR-13 - Risk Classification

Risk classification assigns different governance and legal obligations to automated systems based on their potential for harm. High-risk systems — those affecting employment, credit, health, safety or fundamental rights — face the most demanding requirements. Classification is a governance prerequisite: it determines what obligations apply before deployment begins.

LR-14 - Contestability

Contestability is the practical ability to challenge an automated decision — not merely the legal right to do so. The right exists in law. The ability depends on whether the organisation has built the processes, records and human review capacity to make challenge genuinely possible.

LR-15 - Redress

Redress is what happens after a successful challenge — the correction, the remedy, the reversal of harm. Without effective redress, contestability has no consequence, accountability has no meaning, and the people harmed by automated decisions have no practical recourse.

LR-16 - Insurance

Insurance transfers some financial consequences of AI-related liability to a third party. Insurers ask the same governance questions as regulators — about control, oversight and accountability — but before anything goes wrong, and they price the answers.

LR-17 - Senior Manager Accountability

The Senior Managers and Certification Regime requires named individuals to hold personal accountability for defined areas of a regulated firm's operations. Where AI systems operate within those areas, the named senior manager is personally accountable for how those systems are governed, what controls exist and what happens when they fail.

LR-18 - Conformity Assessment

The EU AI Act requires operators of high-risk AI systems to complete a conformity assessment before deployment. This is a formal, documented process establishing that the system meets the requirements of the Act. Deploying a high-risk system without a completed conformity assessment is itself a breach, independent of whether the system causes harm.

LR-19 - Insurance and AI Liability

Insurers covering organisations that operate AI systems are increasingly requiring evidence of governance, controls and documented risk management as conditions of cover. Where that evidence does not exist, cover may be denied, voided or subject to exclusion. The organisation bears the uninsured loss.

LR-20 - Automated Decision Rights

Article 22 of the UK and EU GDPR gives individuals the right not to be subject to a decision based solely on automated processing where that decision produces a legal or similarly significant effect on them. Where that right applies, the organisation must have a lawful basis for the automated decision, must provide the individual with specific rights and must be able to demonstrate both.

LR-21 - Discrimination and Protected Characteristics

Equality law in the UK and equivalent instruments across EU member states prohibit discrimination on protected characteristics including race, sex, age, disability, religion and sexual orientation. Where an automated system makes or substantially influences decisions about people, the organisation is liable for discriminatory outcomes that system produces. The fact that an algorithm made the decision is not a defence.

LR-22 - Directors Duties and AI Oversight

Directors have a legal duty to exercise reasonable care, skill and diligence in the management of the organisation. Where AI systems make or substantially influence material decisions, that duty extends to understanding what those systems are doing, ensuring adequate controls exist and maintaining evidence that oversight was exercised. A director who cannot demonstrate active oversight of a material AI system has not discharged their duty.

LR-23 - Health and Safety Obligations

"Health and safety law in the UK and across EU member states requires employers and controllers of work premises to ensure, so far as is reasonably practicable, the health, safety and welfare of workers and others affected by their operations. Where AI systems operate in physical environments, control machinery, monitor worker conditions or make decisions that affect safety-critical activities, health and safety obligations attach to those systems and to the people responsible for them.

LR-24 - Post-Market Monitoring

The EU AI Act imposes ongoing obligations on providers and deployers of high-risk AI systems after deployment. These include monitoring system performance, detecting and reporting serious incidents, and updating technical documentation when the system changes materially. Deployment is not the end of the compliance obligation. It is the beginning of a continuous one.

LR-25 - Decommissioning and Residual Liability

When an AI system is retired, the legal obligations attached to what it did during operation do not retire with it. Records must be retained for the applicable legal periods. Claims, investigations, and regulatory proceedings can commence long after a system is switched off. An organisation that destroys records at decommissioning destroys its ability to defend decisions made during the system's operational life.

LR-26 - Public Sector AI Accountability

Public bodies using AI systems to make or substantially influence decisions that affect individuals are subject to accountability obligations that do not apply to private organisations. These include the duty to inquire before making decisions, the obligation to act within statutory powers, the requirement that statutory decision-making authority cannot be delegated to an automated system, and exposure to judicial review where those obligations are not met.

LR-27 - Supply Chain Liability and Non-EU Vendors

Under the recast EU Product Liability Directive, where a non-EU manufacturer supplies AI systems into the EU, liability does not stop at the border. If the manufacturer has no EU presence, responsibility shifts to EU-based economic operators in the supply chain. While a deploying organisation is not automatically treated as the manufacturer, it can face strict liability where it effectively assumes that role — through integration, modification, or control of a safety-critical system. EU organisations cannot treat third-party AI systems as someone else's risk. If the upstream vendor is outside the EU's reach, liability will attach somewhere in the EU-facing chain, and in certain configurations that may include the deployer.
